    mad Just yesterday went fishing in my neighbor's boat which is at 15' 5" in length,around the first island when I was approached by the va.beach marine police which pulled me over for a inspection.Had a empty extinguisher and expired flares.Well,he wrote me up for the expired flares,but I was thought that because of the size of the boat that the boat falls under "jon boat" which do not require such a thing as flares

    Requirements for Visual distress signals can be found here:


    Boats less than 16 feet in length,  when operating from sunset to sunrise, must carry approved night distress signals.

    visual distress signals must be in serviceable condition, readily accessible, and certified by the manufacturer as complying with U.S.C.G. requirements.

    I would guess that even if not required to be on board they should still be serviceable.
