    Hello. I got my 100t Masters a few years ago and now have opened a charter fishing service. My boat will be operating as an OUPV. I will be departing from Scituate, MA, and fishing on Stellwagen. I'm looking for the laws/rules on
    1. Epirb regs. Who needs one?
    2. Life raft regs. Who needs one? (is it based on boundry line?)
    3. If a mate is on board only to assist in fishing, does he need to be in a drug
        testing program?

    I have searched te CFR's, but, can't find any rulings.

    Contact USCG Sector Boston. They will be able to give you the most accurate information available.

    You are a LIc master, you should know that all the req info is contained in 46 cfr, and if you are tageting certain speices such a HMS, the requiements set forth in Cub Chapter c for uninspected fishing vessels.

    EPIRB & Life raft regs aside... wouldn't you just want that stuff on board, regs or not??? I'm not being rude, I'm just curious as to why one would wonder about regs first & safety second. The mate and the drug testing thing, well I can see where you might want to know if its mandatory or if you should just have him go for piece of your own mind. I wouldn't want my mate lighting up just because he doesn't have to be tested. But I think an EPIRB and a raft would be something you would want regardless of the law. Just curious...

    Abide by CFR 46 as well as what federal fishing permits you have because some require specific safety gear for certain times of the year to be onboard for all persons.

    Contact Coast Guard Auxiliary flotilla 12-08 at http://a0131208.uscgaux.info/ and see if they can give you a hand. Between them and the active duty at CG Station Point Allerton, Hull MA you should be able to get everything squared away. If the 'mate' is not salaried or any sort of employee and works only for tips that may very well be considered differently than a paid hand.
